The short version

Consumers in the EU, the UK and Switzerland can withdraw from a purchase within 14 days without giving a reason.Because your fax is sent, and your plan’s access opens, immediately at your express request, you lose the right of withdrawal as soon as performance begins: no payment is refunded under it, and subscription payments are final as our Refund Policy says.To withdraw, email help@faxly.com. 01Right of withdrawal

You have the right to withdraw from this contract within 14 days without giving any reason. The withdrawal period will expire after 14 days from the day of the conclusion of the contract. To exercise the right of withdrawal, you must inform us (THEONLINESAASCOMPANY LLC, 1309 Coffeen Avenue, STE 1200, Sheridan, WY 82801, United States, help@faxly.com) of your decision to withdraw from this contract by an unequivocal statement (e.g. a letter sent by post or an email). You may use the model withdrawal form below, but it is not obligatory. To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.

02Effects of withdrawal

If you withdraw from this contract, we shall reimburse to you all payments received from you without undue delay and in any event not later than 14 days from the day on which we are informed about your decision to withdraw from this contract. We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement.

03Immediate performance and the loss of the right

Faxly performs the service the moment your payment is confirmed: your fax is sent, and a Faxly Standard plan’s access opens, at once. By placing your order you expressly request that we begin performing the service before the withdrawal period ends, and you acknowledge that you lose your right of withdrawal as soon as performance has begun. A fax sent and a period of access opened are services performed immediately and personally for you, with your document to your recipient; they cannot be returned, undone or passed on to anyone else, which is why the right ends when performance begins and no payment — for a 48-Hour Pass or for a Faxly Standard plan, within the 14 days or after them — is refunded under it. You can still cancel online at any time to stop the next charge, pages that do not arrive are never charged, and a 48-Hour Pass whose fax we could not deliver at all is refunded in full. Our Refund Policy applies to everyone regardless of this notice.

05Who this applies to

This notice implements the right of withdrawal for consumers in the European Union, the United Kingdom and Switzerland. It does not limit our Refund Policy, which applies to every customer, and it does not apply to purchases made by businesses.
