Terms of Service

EFFECTIVE OCTOBER 21, 2026 · THEONLINESAASCOMPANY LLC

The short version

You upload a document, we send it to the fax number you give us and give you a timestamped receipt of what the receiving machine confirmed.Fax is not a guaranteed medium: a line can be busy, a machine switched off or out of paper, a confirmation wrong or late. We retry, we never charge for pages that do not arrive and we refund a pass we could not deliver at all — but we cannot promise that a fax arrives, when it arrives or that it is legible, and you must not rely on Faxly alone for a deadline, an emergency or anything that cannot fail. Confirm receipt with the recipient yourself. The $1.99 pass — shown in your local currency where we have one — continues as Standard unless you cancel within 48 hours — at $79 every 4 months, billed every 121 days, for a pass bought from 17 October 2026 up to 31 October 2026, 17:00 UTC, and at $19.99 every 4 weeks for a pass bought after that. Cancelling is two clicks, online, and stops the next charge; subscription payments are not refunded. No junk faxes. Unsolicited fax advertising is illegal under US law (TCPA) and gets accounts banned.Disputes are resolved by individual arbitration unless you opt out within 30 days of accepting these terms.

01What Faxly is

Faxly is an online fax service operated by THEONLINESAASCOMPANY LLC, a Wyoming limited liability company operating as Faxly ('Faxly', 'we', 'us'). We convert documents you upload into fax transmissions, deliver them over telecommunications carrier networks to the numbers you specify, and provide delivery confirmations. These Terms are a binding agreement between you and THEONLINESAASCOMPANY LLC

02Eligibility and your account

You must be at least 18 years old (or the age of majority where you live) to use Faxly. You agree to provide a working email address and keep your account details accurate — receipts, renewal reminders, and legal notices go there. You are responsible for all activity under your account and for keeping sign-in access to your email secure. One account per person or business.

03Acceptable use

You may not use Faxly to send unsolicited advertisements ('junk faxes') prohibited by the Telephone Consumer Protection Act, 47 U.S.C. § 227, and FCC rules, or equivalent laws where you or your recipient are located; to send content that is unlawful, defamatory, harassing, threatening, or fraudulent; to violate another person's privacy or intellectual-property rights; or to impersonate any person or organization. We may suspend or terminate accounts that violate this section, and we cooperate with law enforcement where legally required. To report abuse, use the Report Spam page. Faxly is operated from the United States and complies with US sanctions and export-control laws: we do not transmit to destinations, persons, or organizations that US law prohibits us from serving, and you may not use Faxly from, or for the benefit of, any of them.

04Fax sender identification

US law (47 C.F.R. § 68.318(d)) requires every fax to display the date and time of transmission, the sender's identity, and the sending number in its margin or header. Faxly adds this header automatically using your account information. You agree to keep that information accurate and not to alter or falsify sender identification.

05Electronic communications and E-SIGN consent

By creating an account you consent to do business with us electronically and to receive service communications — receipts, delivery updates, renewal reminders, and legal notices — by email, consistent with the federal E-SIGN Act. If you give us a mobile number for delivery texts, message and data rates may apply and you can opt out anytime by replying STOP. You may withdraw electronic-communications consent by closing your account; we cannot provide the service without it.

06Payment, automatic renewal, and price changes

The 48-Hour Pass costs $1.99 — or, where the English site shows prices in your local currency, €1.99, £1.99, CA$2.99, A$2.99, ¥315 or ₩2,700 — and includes up to 50 pages. UNLESS YOU CANCEL WITHIN 48 HOURS, THE PASS CONTINUES AUTOMATICALLY AS FAXLY STANDARD UNTIL YOU CANCEL: FOR A PASS BOUGHT FROM 17 OCTOBER 2026 UP TO 31 OCTOBER 2026, 17:00 UTC, AT $79 (€79, £79, CA$99, A$99, ¥15,800 OR ₩79,000) EVERY 4 MONTHS — A BILLING PERIOD OF 121 DAYS — (500 pages per cycle); FOR A PASS BOUGHT AFTER THAT, AT $19.99 (€19.99, £19.99, CA$29.99, A$29.99, ¥3,149 OR ₩24,900) EVERY 4 WEEKS (500 pages per cycle). The pay step states the terms that apply to your purchase before you pay, and a plan keeps the terms it started on. You can cancel online — the same way you signed up — at any time, as automatic-renewal laws such as California's require. Each subscription payment is final once it has been made: section 07 and our Refund Policy explain. Prices on the English site are in US dollars — or in your local currency where the site shows one — and exclude any applicable taxes; prices on the Traditional Chinese, Simplified Chinese, Malay, Arabic and Hebrew sites are in US dollars and exclude any applicable taxes; prices on the German, French, Italian, Spanish, Portuguese, Swedish, Norwegian, Polish, Danish, Finnish and Dutch sites are in EUR and are final prices including VAT where it applies; prices on the Japanese site are in JPY and include consumption tax; prices on the Korean site are in KRW and include VAT. We will give at least 30 days' email notice before any price increase, which applies only to subsequent renewals.

07Cancellation and refunds

You can cancel online in two clicks from Settings, with no cancellation fee and no phone call. Cancelling stops the next charge; your plan stays active until the end of the period you have paid for. Subscription payments — the first Faxly Standard charge when a pass continues and every renewal after it, every 121 days or every 4 weeks as your plan’s terms state — are final and non-refundable. We do not refund unused time or pages, a cycle you forgot to cancel, or the current period when you cancel. What you buy is a service we perform immediately and personally for you: your document, sent to your recipient, the moment you order. It cannot be returned once it has been sent, and neither a fax nor a period of access can be passed on or sold to anyone else — which is why there is nothing to give back and no refund for it. Pages that do not arrive are never charged, and a 48-Hour Pass whose fax we could not deliver at all is refunded in full, as our Refund Policy — part of these Terms — sets out. Consumers in the EU, the UK and Switzerland have a statutory 14-day right of withdrawal, explained in our Right of Withdrawal notice: because your fax is sent immediately at your request, that right ends for the fax once it has been delivered, and if you withdraw from a Faxly Standard plan within 14 days of your purchase you pay for the part already provided and we refund the rest. Consumers in Korea have a 7-day right of withdrawal under the E-Commerce Act, explained in the same notice and limited in the same way. Nothing in this section limits a right the law gives you that cannot be excluded.

08Delivery policy and service availability

Your fax is transmitted as soon as your payment is confirmed. Most faxes arrive within about five minutes; long documents and busy receiving lines take longer, and you can watch the progress live or close the page and wait for our email. Those are typical times, not a promise: section 09 says what we can and cannot guarantee. Delivery depends on the receiving machine answering and confirming; we retry busy and unanswered lines automatically and report the outcome as the carrier reports it to us. If a fax cannot be delivered after our retries, we tell you by email, the pages are not counted against your plan or charged, and you can try again free or resend it to a corrected number from your dashboard. A delivery receipt records the receiving machine’s confirmation; section 10 says what it proves and what it does not. Faxly delivers to fax numbers in the countries offered in the send form and cannot deliver to destinations subject to US sanctions. We work to keep Faxly available at all times but do not guarantee uninterrupted or error-free service; scheduled maintenance is announced in advance where practical.

09No guarantee of delivery

FAX IS A TRANSMISSION OVER TELEPHONE NETWORKS TO A MACHINE WE DO NOT CONTROL. IT HAS INHERENT LIMITATIONS AND IS NOT 100% RELIABLE, AND YOU ACKNOWLEDGE THAT WE PROVIDE FAX TRANSMISSION ON A REASONABLE-EFFORTS BASIS ONLY: OUR OBLIGATION IS TO MAKE COMPETENT, REASONABLE EFFORTS TO TRANSMIT YOUR FAX, NOT TO ACHIEVE ITS DELIVERY. WE DO NOT GUARANTEE THAT ANY FAX WILL BE DELIVERED; THAT IT WILL BE DELIVERED WITHIN ANY TIME OR BY ANY DEADLINE; THAT IT WILL BE COMPATIBLE WITH THE RECEIVING MACHINE, SYSTEM OR SERVICE; THAT IT WILL BE COMPLETE OR LEGIBLE AT THE RECIPIENT’S END; THAT OUR RETRIES WILL SUCCEED; OR THAT A DELIVERY CONFIRMATION OR STATUS REPORT WILL BE AVAILABLE, ACCURATE OR ON TIME. TO THE FULLEST EXTENT PERMITTED BY LAW, YOU BEAR THE RISK OF A FAILED, DELAYED, INCOMPLETE OR MISDIRECTED TRANSMISSION, AND WE ARE NOT LIABLE FOR A FAX THAT FAILS, IS DELAYED OR ARRIVES INCOMPLETE BECAUSE OF: the receiving machine being switched off, out of paper or toner, out of memory, misconfigured or faulty; a busy, unanswered or disconnected line, however many times we retry; a number that is wrong, unassigned, disconnected or not a fax line, including one you typed or chose wrongly; the receiving machine or service rejecting, filtering or discarding the fax; congestion, outages, faults or interference on the telephone networks and internet connections between us and the recipient; the failures or limits of the carriers and other providers we rely on to transmit; a power cut or another event at the recipient’s premises; incompatibility between the sending and receiving equipment or their settings; or any other technical, environmental or operational cause outside our direct control. What we do when a fax fails is set out in sections 07 and 08: the pages are not charged, you can resend free, and a pass whose fax we could not deliver at all is refunded. This section describes the limits of fax and the obligation we take on; it does not take away any right consumer law gives you that cannot be excluded, and nothing in these Terms excludes liability for death or personal injury caused by our negligence, for fraud, or for our wilful misconduct.

10Delivery receipts, and checking receipt yourself

A delivery receipt records that the receiving machine confirmed the pages to the carrier, with the time, the number and the page count. It is proof of what that machine confirmed and nothing more: not that the pages were printed, were legible, were read or were acted on. A confirmation can also be wrong or late — a receiving machine or a carrier can report pages that never printed, a status can change after you have read it, and a failure can be reported hours later. YOU MUST VERIFY RECEIPT THROUGH INDEPENDENT MEANS WHEREVER RECEIPT MATTERS. OUR RECEIPTS, STATUS PAGES AND EMAILS ARE NOTIFICATIONS, NOT A SUBSTITUTE FOR THAT CHECK, AND YOU AGREE NOT TO RELY ON THEM ALONE FOR ANY DOCUMENT WHOSE RECEIPT HAS CONSEQUENCES. For an important document: call the recipient to confirm that every page arrived and is legible; ask for a written or emailed acknowledgement; send early enough to try again, or to use another method, if the fax fails; and keep the receipt together with the recipient’s acknowledgement. To the fullest extent permitted by law, we are not liable for a loss that such a check would have avoided or reduced.

11Not for deadlines, emergencies or anything that cannot fail

FAXLY IS NOT DESIGNED FOR, AND YOU MUST NOT RELY ON IT AS YOUR ONLY MEANS OF, TIME-CRITICAL OR MISSION-CRITICAL COMMUNICATIONS. THAT INCLUDES: court filings, legal notices and anything with a legal deadline — complaints, motions, appeals, discovery responses, terminations, notices of claim; medical emergencies and urgent healthcare communications — emergency prescriptions, critical test results, time-sensitive instructions for a patient’s care; financial deadlines — loan and mortgage documents, trading instructions, payment authorizations with a time limit; time-sensitive contracts, offers, bids, tenders and proposals that expire; tax, regulatory and compliance filings with a due date; emergency notifications and urgent business communications; and any communication where a failed, late, incomplete or illegible delivery could cause financial loss, legal consequences, harm to a person or the loss of a right. FOR SUCH COMMUNICATIONS, USE A METHOD DESIGNED FOR THEM — CERTIFIED OR REGISTERED MAIL, A COURIER, HAND DELIVERY, OR THE ELECTRONIC FILING SYSTEM THE RECIPIENT PROVIDES — OR USE FAXLY ONLY BESIDE SUCH A METHOD AND EARLY ENOUGH TO USE IT IF THE FAX FAILS. IF YOU SEND SUCH A COMMUNICATION THROUGH FAXLY, YOU DO SO AT YOUR OWN RISK AND WITH THE CHECKS OF SECTION 10, AND YOU ACKNOWLEDGE THAT A LOSS FROM ITS FAILURE OR DELAY IS NOT ONE WE COULD FORESEE OR HAVE AGREED TO BEAR, TO THE FULLEST EXTENT PERMITTED BY LAW.

12Your content

You retain all rights to the documents you send and receive. You grant Faxly a limited, non-exclusive license to process, convert, transmit, and temporarily store your documents solely to provide the service. We do not read, mine, or use your documents for any other purpose, and they are purged after delivery under our Privacy Policy. You are solely responsible for the content of what you send and for having the right to send it.

13Intellectual property and DMCA

The Faxly name, logo, software, and site design are the property of THEONLINESAASCOMPANY LLC and are protected by law; these Terms grant you no rights in them other than to use the service. If you believe material transmitted through Faxly infringes your copyright, send a notice compliant with the Digital Millennium Copyright Act (17 U.S.C. § 512) to abuse@faxly.com. We terminate repeat infringers.

14Privacy

Our Privacy Policy — including the California and other state-law disclosures in it — explains what we collect and how we handle it, and is incorporated into these Terms by reference.

15Disclaimers

FAXLY IS PROVIDED 'AS IS' AND 'AS AVAILABLE', WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT, AND ANY WARRANTY ARISING FROM A COURSE OF DEALING OR USAGE OF TRADE, AND WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE OR ERROR-FREE, THAT ANY FAX WILL BE DELIVERED, COMPLETE OR LEGIBLE, THAT ANY CONFIRMATION, STATUS OR RECEIPT WILL BE ACCURATE OR COMPLETE, OR THAT DEFECTS WILL BE CORRECTED. NO ADVICE OR INFORMATION, ORAL OR WRITTEN, OBTAINED FROM US OR THROUGH THE SERVICE CREATES A WARRANTY NOT STATED IN THESE TERMS. Faxly is a transmission service: we are not responsible for how recipients handle your documents, and nothing on this site is legal, medical, or tax advice. Some states and countries do not allow certain warranty disclaimers, so parts of this section may not apply to you, and nothing in this section takes away a right the law gives you as a consumer that cannot be excluded.

16Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW: (A) FAXLY’S TOTAL LIABILITY FOR ALL CLAIMS ARISING FROM OR RELATING TO THE SERVICE OR THESE TERMS, WHATEVER THE LEGAL BASIS — CONTRACT, WARRANTY, TORT INCLUDING NEGLIGENCE, STATUTE OR OTHERWISE — IS LIMITED TO THE AMOUNTS YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM, AND FOR A CLAIM ABOUT ONE FAX TO THE PRICE OF THE PASS OR CYCLE IT WAS SENT ON; (B) WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, BUSINESS, OPPORTUNITIES, GOODWILL OR DATA, OR FOR A MISSED DEADLINE, A LOST CASE OR CLAIM, A LAPSED RIGHT, A FAILED TRANSACTION OR A DELAYED TREATMENT, HOWEVER CAUSED AND EVEN IF WE WERE TOLD THEY WERE POSSIBLE; (C) WE ARE NOT LIABLE FOR THE CAUSES LISTED IN SECTION 09 OR FOR A LOSS THAT THE CHECKS OF SECTION 10 WOULD HAVE AVOIDED; AND (D) YOUR SOLE REMEDY FOR A FAX THAT COULD NOT BE DELIVERED IS THE ONE SECTIONS 07 AND 08 GIVE: THE PAGES ARE NOT CHARGED, YOU MAY RESEND FREE, AND A PASS WHOSE FAX WE COULD NOT DELIVER AT ALL IS REFUNDED. These limits apply together and are an essential basis of the price we charge: a fax costs little, and that price does not insure what the document is worth to you. Some states and countries do not allow some of these limits, so they may not apply to you. Nothing in these Terms limits liability that cannot be limited by law — including liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for our wilful misconduct or gross negligence — or any statutory right you have as a consumer that cannot be excluded; if you are a consumer in the EU, the UK, Switzerland, Japan or Korea, this section applies only as far as the law of your country allows.

17Indemnification

You will defend and indemnify THEONLINESAASCOMPANY LLC and its officers, employees, and agents against claims, damages, and reasonable legal fees arising from the content you transmit, your violation of these Terms, or your violation of law — including TCPA claims arising from faxes you send.

18Arbitration and class-action waiver

PLEASE READ THIS SECTION CAREFULLY — IT AFFECTS YOUR RIGHTS. Except for small-claims cases and where prohibited by law, any dispute between you and Faxly will be resolved by BINDING INDIVIDUAL ARBITRATION administered by the American Arbitration Association under its Consumer Arbitration Rules, and the Federal Arbitration Act governs this section. YOU AND FAXLY EACH WAIVE THE RIGHT TO A JURY TRIAL AND TO PARTICIPATE IN A CLASS ACTION. You may opt out of arbitration entirely by emailing help@faxly.com (subject 'Arbitration opt-out') within 30 days of first accepting these Terms; opting out does not affect any other part of these Terms. Faxly pays arbitration filing fees for consumer claims under $10,000.

19Governing law, changes, and contact

These Terms are governed by the laws of the State of Wyoming, without displacing consumer protections you are entitled to under the laws of your state of residence. If we make material changes, we will email you at least 14 days before they take effect; continued use after that is acceptance. If any provision is found unenforceable, the rest remains in effect. These Terms and the policies they incorporate are the entire agreement. Formal complaints: if something went wrong and you want a person to look at it, use the form at faxly.com/complaint — a person reads every complaint and answers within two business days. California users: under Cal. Civ. Code § 1789.3, you may reach the Complaint Assistance Unit of the California Department of Consumer Affairs at 1625 North Market Blvd., Suite N 112, Sacramento, CA 95834 or (800) 952-5210.
